Bankruptcy Law: A Silver Bullet Every capitalized society has an uniform bankruptcy Code. With the Insolvency and Bankruptcy Code, 2016 finally becoming a reality, we have reasons to be optimistic. While the Code has drawn influence from insolvency laws in developed jurisdiction, the Indian challenges are unique and complex. The crucial question is can the new law do away the legacy of long drawn litigations? Can the Code preserve the economic value of the assets? Is it going to ensure speedy recovery which is non-existent in the current set up?
